Private Entrepreneur Horshov Serhii Mykolaiovych, identification code 2920008550 hereinafter referred to as the “Provider”, offers any individual or legal entity (hereinafter referred to as the “User”) to enter into this public contract (Offer) for the provision of information services through the web service LOYAL CARDS (hereinafter referred to as the “Service”) under the software-as-a-service (SaaS) model.
This Offer is a public contract in accordance with Articles 633, 641 of the Civil Code of Ukraine. The contract is concluded without the need for signing a written copy.
The Provider provides the User with information services — access to the functionality of the Service for creating and managing loyalty programs, including digital cards, customer interaction interfaces, analytics, mailings, etc.
Acceptance of this offer is registration in the Service and/or making a payment by any of the methods provided in clause 5 of this Offer. Acceptance means full acceptance of all terms of this Agreement, as well as the Privacy Policy and Terms of Service presented on this site, without reservations.
The Service is provided on an “as is” and “as available” basis. The Provider does not guarantee continuity, error-free operation, or full compliance with the User's expectations.
The functionality of the Service and tariff plans may change unilaterally without prior notice. The cost and description of current tariff plans are posted on the official LOYAL CARDS website.
The User is fully responsible for complying with the terms and policies of third parties when using services such as Google Wallet, Apple Wallet, Telegram, WhatsApp, etc.
The Service may include integrations or the ability to interact with third-party platforms, including Google Wallet, Apple Wallet, Telegram, WhatsApp, etc.
The User is solely responsible for familiarizing themselves with and complying with all policies, technical requirements, terms of use, and license agreements of the respective third-party services. The Provider is not responsible for the consequences of violating these terms.
Services are paid in advance according to the selected tariff plan and payment period.
Payment is made exclusively in a non-cash form — using remote banking systems and/or money transfer services (in accordance with the requirements of Ukrainian legislation).
The fact of payment confirms that the service is provided and accepted without remarks. Acts of completed work are not formed, except in cases where the User initiates them independently through the Vchasno service (https://vchasno.ua).
The Provider offers the opportunity to familiarize oneself with the functionality of the Service for free by using the conditionally free tariff STARTUP.
By making a payment, the User confirms familiarity with the capabilities of the Service, satisfaction with the quality of services, and waives the right to a refund.
Services are considered provided from the moment of payment and are non-refundable, except in cases provided by law.
The Provider is not liable for indirect damages, data loss, or failures. The Service is provided without any warranties.
The User may terminate the use of the Service by stopping payment. In this case, access will be terminated after the already paid period ends.
Data is stored for 30 days. During this period, billing continues. Restoration is possible after full debt payment.
After 30 days, the Provider has the right to delete all data and terminate the contract unilaterally.
Software, interface, logos, etc., are the property of Private Entrepreneur Horshov Serhii Mykolaiovych.
Copying, modifying, or using components of the Service without permission is prohibited.
The User agrees to the use of logos for marketing purposes by the Provider.
The contract is governed by the laws of Ukraine. Disputes are resolved at the place of registration of the Provider.
